Terms & Conditions
These Terms & Conditions govern enrolment in and participation in any programme offered by Bayu at our Kuala Lumpur centre. By registering for a programme, you confirm that you have read, understood, and agreed to these terms.
Definitions
In these Terms & Conditions, the following expressions carry the meanings set out below:
- "Bayu", "we", "us", or "our" refers to Bayu, located at 3rd Floor, Mid Valley Megamall, Lingkaran Syed Putra, 59200 Kuala Lumpur.
- "Programme" means any workshop, course, or structured learning session offered by Bayu, including the Teen Money Quest Workshop, Young Savers Programme, and Teen Finance Foundations Course.
- "Participant" refers to the teen enrolled in a Programme.
- "You" or "User" refers to the parent or guardian registering on behalf of a Participant, or any adult enrolling directly.
- "Content" means all materials, workbooks, handouts, badge sheets, reference packs, and learning resources produced by Bayu for use within a Programme.
- "Agreement" means these Terms & Conditions together with any enrolment confirmation or programme-specific document provided at the time of registration.
Acceptance of Terms
By submitting a registration form, making payment, or permitting a Participant to attend a Programme session, you confirm your acceptance of this Agreement.
- You must be at least 18 years of age and legally capable of entering a binding agreement to register on behalf of a Participant.
- Programmes are designed for Participants aged 13 to 17. A parent or guardian consent form is required for all Participants under 18.
- If you do not agree to these Terms & Conditions, you should not proceed with registration.
Service Description
Bayu provides structured financial education programmes for young people at a general educational level. All content is designed for teens aged 13 to 17 and is delivered at our Mid Valley Megamall location in Kuala Lumpur.
- Programmes are conducted in person at 3rd Floor, Mid Valley Megamall, unless a change of venue or format is communicated in advance.
- Session schedules, dates, and group sizes are confirmed at the time of registration.
- Bayu reserves the right to reschedule or consolidate sessions where necessary, with reasonable prior notice given.
- Programme availability is subject to minimum and maximum group size requirements. We reserve the right to cancel a session cohort that does not meet the minimum number of enrolled Participants, in which case a full refund will be provided.
Enrolment & Registration
Registration for any Bayu programme is completed via our online enquiry form or in person at our centre.
- Enrolment is confirmed only upon receipt of full programme payment and a completed consent form (where applicable).
- You are responsible for providing accurate information during registration, including the Participant's name, age, and any relevant considerations (e.g. learning support needs).
- Bayu may decline or cancel an enrolment at its discretion where the information provided is inaccurate or where continued participation would not be appropriate.
- You are responsible for keeping any login credentials for our registration or communication platform secure and confidential.
User Responsibilities
By enrolling a Participant or attending a session, you agree to the following:
- Participants must attend sessions punctually and behave respectfully toward facilitators and other Participants.
- Disruptive, aggressive, or inappropriate behaviour may result in a Participant being asked to leave a session without refund.
- You will not attempt to record, photograph, or reproduce any session content without prior written consent from Bayu.
- You will not share, copy, redistribute, or commercially exploit any materials provided by Bayu as part of a Programme.
- Parents and guardians are responsible for ensuring the Participant attends sessions as scheduled. Bayu is not responsible for absences due to personal circumstances.
Intellectual Property
All Content provided within Bayu Programmes — including workbooks, badge sheets, reference packs, session slides, and facilitation materials — is the intellectual property of Bayu.
- Upon enrolment, Participants are granted a limited, personal, non-transferable licence to use the Content for their own private educational purposes during and after the Programme.
- This licence does not permit copying, reproducing, adapting, or distributing Content for any commercial purpose or for use by third parties.
- The Bayu name, logo, and all associated branding are proprietary. You may not use them without prior written permission.
Payment & Fees
All fees are quoted and payable in Malaysian Ringgit (MYR/RM).
- Teen Money Quest Workshop: RM 450 per Participant
- Young Savers Programme: RM 1,420 per Participant
- Teen Finance Foundations Course: RM 3,600 per Participant
- Payment in full is required to confirm enrolment. Bayu does not currently offer instalment payment plans unless separately arranged in writing.
- Accepted payment methods include online bank transfer, credit/debit card, and cash at our centre. Specific payment details are provided upon registration.
Refund Policy:
- Cancellations made 14 or more calendar days before the first session: full refund of the programme fee.
- Cancellations made 7 to 13 calendar days before the first session: 50% refund of the programme fee.
- Cancellations made fewer than 7 calendar days before the first session: no refund is available, though a transfer to a future cohort may be arranged at Bayu's discretion.
- If Bayu cancels a session cohort, a full refund will be issued within 14 business days.
- Refunds are processed to the original payment method only.
Programme-Specific Terms
The following additional terms apply to Bayu's educational Programmes:
- Attendance: Regular attendance is encouraged for Participants to gain full benefit from the programme. Missed sessions cannot be refunded but may be noted for catch-up material at facilitator discretion.
- Completion: There is no formal examination or academic qualification associated with Bayu Programmes. Badge sheets and reference packs are provided as learning tools, not as accredited certificates.
- Content Level: All Content is prepared at a general educational level for young people and does not constitute financial advice, investment guidance, or regulated financial services of any kind.
- Age Suitability: Programmes are designed and reviewed for Participants aged 13 to 17. Bayu reserves the right to decline enrolment where a Participant falls outside this range.
- Parental Consent: A signed consent form from a parent or guardian is required for all Participants under the age of 18 before attendance is permitted.
Disclaimers
Bayu Programmes are provided on an "as available" basis for general educational purposes only.
- Nothing within any Bayu Programme, session, material, or communication constitutes regulated financial advice, investment advice, legal advice, tax advice, or any other form of professional advisory service.
- Bayu does not make any representations about the financial outcomes or behaviour changes that may result from attending a Programme.
- Facilitators are education practitioners, not licensed financial advisers. Any discussion of financial topics is for illustrative and informational purposes only.
- Bayu does not warrant that Programmes will meet every Participant's specific learning needs or expectations.
Limitation of Liability
To the fullest extent permitted by Malaysian law:
- Bayu's total liability to you in connection with any Programme shall not exceed the total fee paid for that Programme.
- Bayu shall not be liable for any indirect, special, consequential, or incidental losses arising from participation in a Programme or use of Programme Content.
- Bayu shall not be liable for delays, cancellations, or changes to Programme schedules arising from circumstances beyond our reasonable control, including but not limited to public health directives, facility closures, natural events, or government orders (force majeure).
- Nothing in these Terms & Conditions limits Bayu's liability for death or personal injury resulting from our negligence, or any liability that cannot be excluded under applicable Malaysian consumer protection law.
Indemnification
You agree to indemnify, defend, and hold harmless Bayu and its staff, facilitators, and contractors from and against any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms & Conditions;
- A Participant's misconduct during or in connection with a Programme session;
- Any inaccurate information provided during the registration process.
Termination
Either party may terminate participation in a Programme as follows:
- By you: You may withdraw a Participant from a Programme at any time. Refunds are subject to the cancellation policy in Section 7.
- By Bayu: We may remove a Participant from a Programme without refund if their conduct poses a safety risk, is seriously disruptive, or is in material breach of these Terms. We will endeavour to communicate such a decision in writing.
- Upon termination, the Participant's licence to use Programme Content for personal educational reference continues; however, any rights to attend future sessions are extinguished.
- Sections 6, 9, 10, 11, and 13 of these Terms survive termination.
Dispute Resolution
We hope to resolve any concerns informally. If you have a complaint or dispute, please contact us first at [email protected] and allow us 14 business days to respond.
- If a resolution cannot be reached informally, both parties agree to attempt good-faith mediation before pursuing legal proceedings.
- These Terms & Conditions are governed by and construed in accordance with the laws of Malaysia.
- Any dispute that cannot be resolved by mediation shall be subject to the exclusive jurisdiction of the courts of Malaysia.
- Your rights under the Consumer Protection Act 1999 (Malaysia) and other applicable Malaysian statutes are not affected by these Terms.
General Provisions
- Entire Agreement: These Terms & Conditions, together with any enrolment confirmation or consent form, constitute the entire agreement between you and Bayu with respect to your participation in a Programme.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: A failure by Bayu to enforce any provision of these Terms does not constitute a waiver of our right to enforce it at a later time.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without prior written consent from Bayu. Bayu may assign these Terms to a successor entity in connection with a corporate reorganisation.
- Notices: Formal notices under these Terms should be sent to [email protected] or by post to our registered address.
Changes to These Terms
Bayu may update these Terms & Conditions from time to time to reflect changes in our Programmes, applicable law, or operational practices.
- Material changes will be communicated via email to registered users at least 14 days before taking effect.
- The updated Terms will be published on our website with a revised "Last Updated" date.
- Continued enrolment in or attendance at a Programme after the effective date of any revision constitutes acceptance of the revised Terms.
